Arnold Machinery Company (“AMCO”) is committed
to protecting your privacy and developing technology that gives you a safe and
powerful online experience. This AMCO Privacy Statement (the “Privacy
Statement”) applies to the collection, use and disclosure of personal
information relating to you by AMCO and the AMCO Web site (the “Web Site”). By
using the Web Site, you agree and consent to the data practices described in
this Privacy Statement, and to the collection, use and disclosure of your
Personal Information (as hereinafter defined) by AMCO in accordance with the
terms of this Privacy Statement.
Collection of your Personal
Information
AMCO collects information about identifiable
individuals (“Personal Information”) relating to use of the Web Site by Users,
which may include but may not be limited to Users’ home e-mail addresses,
names, home or work addresses or telephone numbers. AMCO also collects
anonymous demographic information, which is not unique to you, such as your
Postal Code, age, gender, preferences, interests and favorites.
There is also information about your computer
hardware and software (“Computer Information”) that is automatically collected
by AMCO, which may include but may not be limited to your IP address, browser
type, domain names, referring domain names, access times and referring Web site
addresses. AMCO does not access, read, or collect any of your private online
communications made through the Web Site. AMCO also automatically collects data
relating to sites and pages our Users visit within the Web Site (“Web Site
Information”), to determine what AMCO services are the most popular.
Please keep in mind that if you disclose
Personal Information or personally sensitive data through the Web Site’s public
message boards or the Web Site’s public chat functions, this information may be
collected, used, and/or disclosed by other Users. The collection use and
disclosure of Personal Information and personally sensitive data made available
in this fashion cannot be controlled by AMCO, and AMCO does not control and

privacy policies which may not mirror those of AMCO. AMCO encourages you to

Internet resources collect, use and share your information. AMCO has no control

collection, use and disclosure of your Personal Information, and AMCO accepts

disclosure of your Personal Information by such other external Web sites or
Internet resources.
Use of your Personal
Information
AMCO uses your Personal Information to operate
the Web Site and deliver the services you have requested. AMCO also uses your
Personal Information to inform you of other products or services available. AMCO
may also contact you via surveys to conduct research about your opinion of
current services or of potential new services that may be offered in the
future.
Computer Information, as defined above, is used
by AMCO for the operation of the services provided to you via the Web Site, to
maintain the quality of the services provided through the Web Site, and to
provide AMCO with general statistics relating to use of the Web Site. Web Site
Information, as defined above, is used to deliver customized content and
advertising within the Web Site to customers whose behavior indicates that they
are interested in a particular subject area.
AMCO does not sell, rent or lease its customer
lists to third parties. AMCO may, from time to time, contact you on behalf of
external business partners about a particular offering that may be of interest
to you. In those cases, your unique Personal Information (e-mail, name,
address, telephone number) is not transferred to the external business partner.
In addition, AMCO may share data with trusted partners to provide services to AMCO,
which services may include performing statistical analysis, sending you email
or postal mail, providing customer support, or arranging for deliveries. All
such partner service-providers are prohibited from using your Personal
Information, except to provide these services to AMCO, and are required to
maintain the confidentiality of your Personal Information.
AMCO does not use or disclose sensitive
Personal Information, such as Personal Information relating to your race,
religion, or political affiliations, without your explicit consent.
AMCO may use or disclose your Personal
Information, without notice, if legally permitted to do so according to any
relevant privacy enactments (“Privacy Acts”). The Privacy
Acts may permit the use or disclosure of Personal Information without notice
if, for example: (a) the Personal Information could be useful in the
investigation of a contravention of the laws of the State of Utah and the
United States; (b) the Personal Information is used or disclosed for the
purpose of acting in respect of an emergency that threatens the life, health or
security of an individual; and (c) the Personal Information is disclosed to
comply with the edicts of the law, or to comply with a subpoena or warrant
issued or an order made by a court. AMCO may also disclose your Personal
Information if AMCO holds the good faith belief that such action is necessary
to protect and defend the rights or property of AMCO and/or act under exigent
circumstances to protect the personal safety of users of AMCO, or the public.
Use of Cookies
The Web Site uses “cookies” to help

environment, protected from unauthorized access, use or disclosure. When

purposes specified above, it is protected.

This Privacy Statement may be changed,
removed, added to or otherwise modified by AMCO from time to time at AMCO’s
sole discretion and without any prior notice or liability to you. The
collection use and disclosure of your Personal Information by AMCO will be
governed by the version of this Privacy Statement in effect at that time. All
new, amended, or otherwise modified terms take effect immediately.
